I.The Matter

A divorce after twenty or thirty years of marriage is not a smaller version of a shorter one. The maintenance, the retirement accounts, and the health insurance were built over an entire career, and the years left to rebuild them are fewer. Indefinite Maintenance After a Long Marriage

Marriages of twenty years or more make a spouse eligible for indefinite maintenance under 750 ILCS 5/504, rather than an award tied to a fixed term. That does not mean maintenance runs forever automatically. It means duration becomes a fully litigated question rather than a formula output, argued alongside the same guideline and above-guideline calculations that apply in any maintenance case.

Dividing a Full Career of Retirement Savings

401(k)s, pensions, and IRAs accumulated over decades are usually the largest asset in a gray divorce, larger than the marital home. Dividing them correctly requires a Qualified Domestic Relations Order drafted to the plan’s specific terms, and valuing a pension’s present value is its own contested exercise separate from dividing a defined-contribution account.

The Health Insurance and Medicare Gap

A spouse who has been covered under the other’s employer plan loses that coverage at divorce, and if that spouse is not yet 65, the gap before Medicare eligibility has to be planned for, through COBRA, a marketplace plan, or a negotiated settlement that accounts for the cost. This is a real financial issue in nearly every gray divorce, and it is too often addressed after the judgment instead of during the negotiation.

Social Security and the Ten-Year Marriage Rule

Illinois courts do not divide Social Security benefits directly, they are governed by federal law, but the marriage’s length still matters: a marriage of ten years or more can entitle a lower-earning spouse to claim benefits on the higher earner’s record without reducing what the higher earner receives. Claiming strategy is a real factor in settlement negotiations, even though the benefit itself is never on the table for division.

Dividing a Business Built Over a Long Marriage

Where a long-term marriage includes a closely held business, the business is frequently the couple’s largest and most complicated asset, appreciated over decades rather than built recently. Valuing and dividing it follows the same rigor as any high-asset business division, just applied to a longer operating history and a larger body of appreciation to trace.

Why Gray Divorce Rarely Involves Custody

Most gray divorces involve adult or nearly adult children, which removes custody and parenting time from the case and puts the full weight of the litigation on maintenance and property. That concentration is an advantage for spouses who prepare, and a risk for spouses who assume the case will be simple because there is no custody fight.
